Terms of Use

1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client") and isCredible.com by Ace|Oar Technologies, Inc. ("we," "us," or "our"), concerning your access to and use of the isCredible platform, API, and software development kits (collectively, the "Service").

By accessing the Service, integrating our SDKs, or using our API, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. Nature of the Service

isCredible provides data intelligence, device fingerprinting, and risk-scoring tools designed to assist digital businesses in identifying potential resource abuse.

Critical Disclaimers:

  • We Provide Recommendations, Not Decisions. The Service provides risk scores and "Approve/Deny" recommendations based on logic you configure. You utilize these recommendations at your own sole discretion. We are not responsible for any business decisions you make based on our data.
  • No Guarantee of Accuracy. Fraud detection is probabilistic. We do not guarantee that the Service will detect 100% of abusive behavior (False Negatives) or that it will never flag a legitimate user as suspicious (False Positives).
  • Not Insurance. We are not an insurer. We are not liable for any financial losses, ad spend wastage, or resource abuse that occurs despite the use of our Service.

3. Integration and Implementation

You are responsible for the proper integration of our API, SDKs, and JavaScript snippets (including the "Lead Quality Firewall" and other pixel-blocking scripts) into your applications or websites.

  • Client-Side Risks: You acknowledge that implementing blocking logic on client-side environments carries inherent risks. We are not liable for any disruptions to your website's functionality, broken forms, or lost tracking data resulting from improper integration or Service downtime.
  • End-User Consent: You represent and warrant that you have obtained all necessary consents from your end-users (including cookie consents and privacy policy disclosures) to allow isCredible to collect and process data (such as IP addresses and device identifiers) for verification purposes.

4. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your API keys and account credentials. You agree to accept responsibility for all activities that occur under your account.

  • Prohibited Use: You may not use the Service to profile users for discriminatory purposes, credit scoring (FCRA compliance), or any illegal activity.
  • Free & Beta Accounts: Services provided under "Free," "Beta," or "Trial" tiers are provided gratuitously. We reserve the right to terminate these accounts, limit API throughput, or delete configuration data at any time, for any reason, without notice or liability.

5. Limitation of Liability (Read Carefully)

To the fullest extent permitted by law, in no event will isCredible.com by Ace|Oar Technologies, Inc., its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages.

This includes, without limitation, lost profit, lost revenue, loss of data, wasted ad spend, loss of goodwill, or other damages arising from your use of the service, even if we have been advised of the possibility of such damages.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the three (3) month period prior to any cause of action arising, or $100 USD, whichever is less.

6. Disclaimer of Warranties

The service is provided on an "As-Is" and "As-Available" basis. You agree that your use of the service will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the service and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uptime availability.

We make no warranty that the risk scores, device fingerprints, or verification results will be accurate, complete, or error-free.

7. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your implementation of the Service; (2) your violation of end-user privacy rights; (3) your breach of these Terms of Use; or (4) any dispute between you and your end-users regarding account bans or blocked access.

8. API Usage and Modifications

We reserve the right to modify API endpoints, response structures, or rate limits at any time. We will attempt to provide reasonable notice of breaking changes, but we are not liable for integrations that break due to Service updates. We reserve the right to suspend access if your API usage places an unreasonable burden on our infrastructure.

9. Governing Law

These Terms shall be governed by and defined following the laws of Canada. isCredible.com by Ace|Oar Technologies, Inc. and yourself irrevocably consent that the courts of Canada shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
